On July 28, 2011, ASHA filed a motion for leave to file an amended prehearing statement and extension of time to file its opening brief “from August 15, 2011 until 30 days after [the Concerned Members] file any supplemental prehearing statement.” On August 8, 2011, we filed the Concerned Members’ response in opposition to the motion.
Today we received a copy of the Court of Appeals’s order ruling on ASHA’s motion. A copy of the order is attached to this email. As reflected therein, leave to file an amended prehearing statement has been denied and a small extension of time has been granted. The deadline for ASHA to file its opening brief is now August 30, 2011.
